Complex Torts: A Definition

Examples would be mass tort cases, mass product liability cases, or injuries caused to many individuals as a result of the same catastrophic event. Complex torts usually involve difficult or new legal issues, that may require many motions, large amounts of evidence, and often have many parties involved.

In recent history, a notable example of complex tort litigation would be the asbestos litigation. Many individuals and organizations were bringing lawsuits to recover for the damages, injuries, and medical care costs associated with exposure to asbestos. This was new territory for the courts, and there were no clear rules yet established to handle an issue that was suddenly flooding the courts.
